DMCA / Copyright Policy

Kaosly respects intellectual property. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).
1. Reporting Copyright Infringement
If you believe content on Kaosly infringes your copyright, submit a takedown notice to our designated agent with:
- Your physical or electronic signature.
- Identification of the copyrighted work(s) claimed to be infringed.
- Identification of the infringing material and its location on the Service (URL).
- Your contact information (name, address, phone number, email).
- A statement that you have a good-faith belief the use is unauthorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

2. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification with:
- Your physical or electronic signature.
- Identification of the removed material and its former location.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, phone number, and consent to jurisdiction of a federal court in your district.
- A statement that you accept service of process from the complainant.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10-14 business days, we may restore the content.
3. Repeat Infringer Policy
We maintain a repeat infringer policy. Users who receive multiple valid copyright complaints may have their accounts terminated. We consider:
- The number and nature of complaints.
- Whether the user filed counter-notifications.
- The outcome of any counter-notification process.
- Whether the infringement appears intentional.
4. Misrepresentation Warning
Under the DMCA, anyone who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages, including costs and attorney's fees. Do not file false claims.
5. AI-Assisted Triage
We may use AI to assist in triaging copyright claims. All claims are subject to human review before action is taken. AI triage helps prioritize urgent claims but does not serve as the sole basis for content removal.
6. Audio and Music
Kaosly provides a library of licensed audio ("Tunes") for use in reels and stories. Using copyrighted music outside of this library without authorization may result in content removal. If a valid claim is made against audio in your content, the audio may be muted while the visual content remains available.
